Terms of Service

1. About ContentSignage

ContentSignage is a cloud digital-signage platform ("the Service"), operated by ContentSignage ("we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms.

2. Acceptance

By using any part of the Service you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the laws of your country. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Your Account

  • You are responsible for keeping your Auth0 sign-in credentials confidential.
  • You are responsible for all activity that occurs under your account and organization, including any paired screens.
  • Notify us immediately at jayprajapati857@gmail.com if you suspect unauthorised access.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful or fraudulent purpose
  • Upload or transmit malware, spam, or harmful or infringing content to your screens
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service, including the Android player
  • Resell or sublicense access to the Service without our written permission
  • Use the Service in a way that could damage, disable, or impair our systems or paired devices

6. Intellectual Property

All software, content, trademarks, and other materials in the Service, including the dashboard and the Android player, are owned by ContentSignage or its licensors. You retain ownership of all data you upload (media files, playlists, screen names). You grant us a limited licence to store, process, and display that data solely to provide the Service to you, including delivering it to your paired screens.

7. Early Access and Subscriptions

The Service is currently in an early-access pilot program and is provided free of charge. If we introduce paid plans, we will give you at least 30 days' prior notice of any pricing changes by email or in-app notification. You may cancel your account at any time with no penalty.

8. Termination

We may suspend or terminate your account if you breach these Terms or if your use poses a risk to the Service or other users. You may request deletion of your account at any time by contacting us at jayprajapati857@gmail.com; your data will be deleted within 30 days of account closure, and any paired screens will stop receiving content updates.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONTENTSIGNAGE AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Region-Specific Provisions

United Kingdom and European Union

If you are located in the UK or EU: (a) nothing in these Terms limits or excludes your statutory rights as a consumer; (b) if we introduce a paid subscription, you have 14 days from the subscription start date to withdraw without charge, unless you have started using the paid features and expressly agreed to waive this right; (c) these Terms and any disputes arising from them will be governed by the laws of England and Wales (for UK users) or the laws of your EU member state (for EU users), and subject to the non-exclusive jurisdiction of the English courts or the courts of your member state.

United States

If you are located in the United States: (a) these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions; (b) any dispute that cannot be resolved informally will be settled by binding arbitration administered under the JAMS Streamlined Arbitration Rules, conducted in English; (c) you waive any right to participate in a class-action lawsuit or class-wide arbitration. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

India

If you are located in India: (a) these Terms are governed by the laws of India; (b) any disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat; (c) we comply with the Digital Personal Data Protection Act, 2023 (DPDP Act); see our Privacy Policy for full details of your rights as a Data Principal.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
